How to get your full security deposit back when you move out

A security deposit is usually two to three months' rent โ€” often โ‚น20,000 to โ‚น60,000 or more. Most tenants get it back short or late. Here's how to make sure you don't.

The deposit is decided on move-in day, not move-out day

The single most important thing you can do is document the room thoroughly before you unpack. Everything that's already damaged or worn is not your responsibility โ€” but only if you can prove it was like that when you arrived.

  • Walk through the room and photograph every wall, the floor, ceiling, bathroom, and any furniture.
  • Record a short video doing the same.
  • Note the electricity meter reading.
  • Send everything to the owner on WhatsApp the same day. The message timestamp is your evidence.

Know what can and can't be deducted

Owners can deduct:

  • Damage you caused (a broken tile, a burned countertop, a missing fixture)
  • Professional cleaning if you left the place in a mess
  • Items that went missing from the furnished inventory

Owners cannot deduct:

  • Normal wear and tear: faded paint, minor scuffs, a loose hinge from years of use
  • Repainting the whole flat if only one wall was scratched
  • Any deduction not listed in the rent agreement

If the agreement doesn't say they can deduct it, push back.

Give proper written notice

Most agreements require one month's notice. Give it in writing โ€” a WhatsApp message is fine. The date you send it is the date you gave notice, so doing this early matters.

During your notice period:

  • Do a joint inspection with the owner and note anything they raise.
  • Fix minor things yourself (a broken hook, a blown bulb) โ€” it's cheaper than the deduction.
  • Get all your belongings and keys out before the last day.

The day you hand over the keys

  • Do a final walkthrough together and agree on the condition in writing.
  • Ask for a written acknowledgement that the keys were returned on that date.
  • Confirm in writing when the deposit will be returned and how.

Most agreements say the deposit is returned within 30 days of move-out. If yours doesn't say, 30 days is a reasonable expectation.

If the owner is slow or deducting unfairly

  1. Send a written request (WhatsApp or email) citing the move-out date and the amount owed.
  2. If no response in 15 days, send a formal legal notice โ€” a lawyer can draft one for โ‚น500โ€“2,000.
  3. For amounts up to โ‚น50 lakh, the Rent Control Court or Consumer Forum is your option. Filing fees are low and you can often represent yourself.
